TERMS OF SERVICE

☆ HOW TO COMMISSION ME :)
1 - I receive your request form -> you get added to the queue (which is always public and free to join)
Please have reference images/gifs prepared for the request! I will need more than written descriptions to provide the best results.
Note that my queue is ongoing and follows a rolling basis; while I generally try to follow a 'first come, first served' basis, I will be choosing requests based on the scope of projects I am able to work on at the moment. Since you may request to join my queue almost anytime, please do not expect an immediate response or available slot upon requesting.2 - I will contact you when it is your turn to confirm your interest with an estimated price breakdown, or to discuss further details as needed. You are not obligated to continue at this point and reserve the right to cancel or request to delay your slot.
I will reach out via email first, and then follow up on Twitter or alternative social media in DMs if there has been no response received within one week. If you provide zero response after 14 days, you will be moved to the end of my queue and move on the next person.3 - After is payment received -> your project is fully confirmed and I start working on it!! :D4 - FINAL DELIVERY: Files will be sent in digital form via email attachment, along with instructions or setup notes if applicable.

☆ PAYMENT
1 - All prices are listed in $USD. I currently accept: Paypal / Stripe
2 - I require 100% payment upfront to confirm your project before I begin working on your commission. General waitlist slots do NOT require any payment to join.
3 - If payment is not made in a timely manner (15 days) after a price is agreed upon and I have sent an invoice, I will send a reminder. If there is still no response or updates in the next few days, the commission slot will be cancelled and I will move on to the next person in queue.
4 - I will initiate the transaction to avoid accidental transactions. Please don't send me any kind of payment until I have confirmed I can accept your commission AND have asked for payment
5 - You reserve the right to request a deadline for your commission. This deadline must be disclosed prior to payment. A rush order fee may apply depending on the situation.

☆ REFUNDS
1 - I have the right to refuse a commission for reasons including but not limited to: I will not be able to finish within a specific deadline; I do not feel confident I can draw a quality product of your character(s)
2 - All commissions are non-refundable unless I have not started working on it yet two weeks after payment OR I cannot finish within the agreed upon deadline
3 - I reserve the right to cancel a commission and issue a full refund if I can no longer work on a paid project for any reason
4 - You are not authorized to issue a chargeback. Contact me immediately if your payment encounters an error or unauthorized refund.
5 - You must contact me to cancel your request.

☆ THE PROCESS / REVISION POLICY
1 - General turnaround time is 1-3 months.
I frequently update things here! This turnaround time estimate refers to when I start on your project, not when you get a queue slot. You reserve the right to be notified of any delays.
2 - Stages upon which I will provide WIP updates and require your approval before moving on:
- (1) rough drafts (doodles + color palette check)
- (2) rough base animations (if any)
- (3) animation cleanup / polish
After the drafts for each stage have been approved, I will only accept minor revision requests unless I have made an error
(i.e. missing accessories, wrong eye color, etc.)
3 - Major revision requests: You may request changes to your current order if the base art has not yet begun (meaning, beyond concept doodles and rough drafts).
4 - Add-ons: I accept requests for additions to the current project on a case-by-case basis, depending on factors such as the scope of the add-on(s), time remaining before deadline, etc. Similar to all other commission requests, your add-on will not be confirmed until I have sent the additional invoice(s) and payment has been received.☆ (AFTER FINAL DELIVERY)
5 - Please provide feedback / updates or minor revision requests within 30 days of final delivery. Any changes to the final art (excluding major mistakes or missing parts) beyond that may be subject to a fee.
In the absence of any feedback or updates from the customer 3 weeks after polished art is pending final approval, the art will be considered finished.
6 - I retain the right to display the art and art process on my live-streams, social media, website, etc.
Details regarding optional NDA / privacy fees will be included in the request form.

☆ USAGE
1 - DO NOT: edit, trace, or modify my art without my permission. Please contact me for changes. You may not claim my art as your own, distribute my art for others to freely use/edit, heavily reference/copy/trace my art, or resell my art.
2 - I require credit by name, link, or tagging me (https://jelleeshop.carrd.co/, Twitch: jelleebun, Twitter @jelleebun) if you post or use my art on your social media or streams; direct tags or links are preferred (I promise you won't be spamming/bothering me :))
Emotes used on Twitch must also have Emote Attribution linked back to me.
3 - I do NOT allow any of my art being used for anything related to blockchain, cryptocurrency, NFTs, or AI learning purposes.
4 - If you've read this far, mention "erica is cool" at the end of my commission request form for a slight discount on your order or small doodle reward.
5 - I have the right to post your finished commission with a watermark on any of my social media sites and/or portfolio, unless a full privacy NDA agreement has been paid for.
6 - Prices listed are for the main intended usage of art only. Please see details below:☆ PERSONAL USE (additional fee: NONE)
for where you will not be earning any money by using the art
- profile pic / banner, sharing on social media with credit, personal wallpaper or print☆ CREATOR USE (additional fee: NONE - already included in pricing)
for content creation with intent of monetization or promotion of personal brand
- stream / content assets ie. panels, logos, emotes, overlays, stream avatars, vtuber models, reactive pngs, thumbnails
- promotional content for direct revenue ie. ads / events / sponsorships, etc.☆ CREATOR USE (EXTENSION) (additional fee: +50% of target art asset price)
for reusing art into multiple forms of content creation usage, with or without minor adjustments
- example 1: turning a Stream Avatar animation into a Discord/Twitch emote
- example 2: reusing the art from an emote and exporting a scaled-up version for a stream alert or Twitch panel☆ COMMERCIAL USE (+200% - 300% of base price)
for direct profiting where the air is the main selling point:
- physical merchandise production keychains, stickers, prints, etc.
- digital goods ie. Patreon or membership rewards, digital wallpapers

☆ FANART POLICY
1 - I will not attempt to exactly replicate art of existing copyrighted characters for exclusive creator use (i.e. BOTW koroks, Pokemon sprites, Genshin slimes, retro Zelda sprites, etc).
Requesting fanart stream avatars or emotes means you have read this and allow me the rights to redistribute/re-sell them as stream assets to other individuals. This can be negotiated if there is enough of a unique customization for you specifically.
2 - Requesting custom accessories of props from existing media for your custom stream avatar design: (example: korok masks for your custom-designed stream mascot). I will likely offer a discounted rate if you allow me to redistribute the art and add it as an option to my premade packs (instead of charging for them like a custom item)._{last updated May 1, 2025.
I reserve the right to modify these terms at any time. Significant changes will be announced on relevant platforms (ie. Discord commission updates channel, Twitter, and Vgen status). Returning clients and continued use of services mean that you accept changes to these terms after updates.}
